Director Ma Linping presented the “One Article a Day from the 2023 Civil Code,” compiled by the legal team, to President Sui Xiaojian and Secretary-General Zhang Weihua of the Dalian Municipal Association of Grassroots Legal Service Workers.
In accordance with the relevant provisions of the Contract Section of the Civil Code, the Supreme People's Court has made adjustments to the original provisions of the Contract Law and, in light of the difficult issues encountered in judicial practice, formulated the “Interpretation on Several Issues Concerning the Application of the General Provisions of the Contract Section of the Civil Code of the People’s Republic of China” (hereinafter referred to as the Judicial Interpretation of the General Provisions of the Contract Section), which took effect on December 5, 2023.
During this lecture, Director Ma Linping focused on the legal provisions of the Contract Section of the Civil Code, providing a detailed explanation—article by article—of the Judicial Interpretation on the General Provisions of the Contract Section. He also analyzed real-life cases chapter by chapter to illustrate key points through practical examples.
At the lecture, Director Ma Linping explained the following four aspects in turn: 1. General provisions of contracts; 2. Conclusion of contracts; 3. Validity of contracts; 4. Performance of contracts. Drawing on his more than 30 years of professional experience and using numerous real-life cases, Director Ma Linping provided vivid and insightful analysis and answers to the attendees, addressing both the newly introduced judicial interpretations and the specific application of the Contract Section, which have been a source of widespread confusion among participants.
Since the promulgation of the Civil Code, Director Ma Linping has led the company’s equity team in launching a daily column titled “One Article from the Civil Code,” tirelessly providing interpretations of laws and regulations from perspectives such as legal commentary and case analysis. The team is deeply committed to publicizing and educating people about the Civil Code through pro bono efforts. At the beginning of this year, Ma’s firm’s equity team released the latest installment of the “One Article from the Civil Code” series, which, in conjunction with the newly effective “Interpretation on Several Issues Concerning the Application of the General Provisions of the Contract Part of the Civil Code of the People’s Republic of China,” sees team members meticulously analyzing each article—examining the underlying legal principles, thoroughly comparing old and new provisions, precisely identifying key phrases, and carefully selecting and studying pivotal cases. Each day, the team updates one article from the Contract Part, offering detailed explanations of every provision in the most straightforward language possible. Additionally, they have added explanations of key articles from the Judicial Interpretation of the General Provisions of the Contract Part, correlating each interpretation directly with its corresponding legal provision and comprehensively organizing the legal relationships under contract law. Meanwhile, they have also compiled typical cases issued by the Supreme People’s Court, exploring the practical applications of these legal provisions in everyday life.
