On March 18, Lawyer Xia Jiacheng, Liaoning Tongfang Law Firm With Partner Attorney Shi Mo At the invitation of the Benxi City Tobacco Monopoly Bureau, I delivered a lecture on legal cases to colleagues from the bureau, themed “Contracts Provide Assurance—Rule of Law Offers Protection.” The lecture focused on three key areas: the Contractual Provisions of the Civil Code, the Tort Liability Provisions, and Administrative Compulsory Measures.

I. The Contract Section: The Cornerstone of Regulating Transactions

A contract is the “web of agreements” in a market economy, seamlessly connecting every link in a transaction. Starting from the practical business operations within the tobacco industry, two lawyers conducted an in-depth analysis of the key provisions in the Contract Section of the Civil Code. From the formation and performance of contracts to liability for breach and contract termination, each stage was meticulously dissected through vivid case studies. For instance, in procurement contracts for tobacco companies, how can contractual clauses be used to effectively mitigate risks? And in sales contracts, how can the rights and obligations of both parties be clearly defined to prevent disputes? The explanation served as a key, opening the door for colleagues at the Tobacco Monopoly Bureau to standardize their transactions.
II. Infringement Section: A Shield for Protecting Rights

Tort liability serves as the legal safeguard protecting individual rights. Through a series of typical cases, two lawyers provided a detailed explanation of the key points in the Tort Liability section of the Civil Code—from common types of torts to the determination of tort liability, from the scope of compensation to grounds for exemption from liability. In the tobacco industry, tortious acts may involve multiple aspects, including product quality and intellectual property rights. By analyzing these cases, colleagues from the Tobacco Monopoly Administration gained a clearer understanding of how to prevent tort risks and how to protect their rights in accordance with the law when torts do occur.
III. Administrative Coercion: The Sharp Sword of Law-Based Administration

Administrative enforcement is an important tool for administrative agencies to achieve their management objectives. Two lawyers, drawing on the unique characteristics of the tobacco monopoly industry, provided a detailed explanation of the implementation of administrative enforcement measures. From seizure and detention to freezing of assets, and from the legality of administrative enforcement measures to the due process involved, they placed particular emphasis on the importance of administering according to law. In tobacco monopoly management, how can we effectively crack down on illegal tobacco products while simultaneously safeguarding the legitimate rights and interests of those subject to administrative actions? How can we maintain market order through lawful administrative enforcement measures? These questions were thoroughly explored during the lecture.
IV. Interactive Exchange: The Clash Between Law and Practice

The atmosphere at the lecture was lively and enthusiastic, with colleagues from the Tobacco Monopoly Bureau actively participating in the interactive session. Drawing on real-world issues from their daily work, they posed questions to the two lawyers, Xia Jiacheng and Shi Mo, who patiently provided insightful answers, creating a highly engaging environment. This interactive exchange not only deepened the colleagues’ understanding of legal knowledge but also closely integrated law with practical application, providing strong support for the Tobacco Monopoly Bureau’s law-based administration and compliant operations.
