On March 28, 2025, the Liaoning Province Construction Industry Association will hold the first public lecture of the 2025 Legal Lecture Series, aiming to further enhance construction enterprises' ability to prevent legal risks, strengthen the legal awareness of practitioners, and promote the healthy and orderly development of the construction industry. Representatives from some member units of the Provincial Construction Association, heads of legal departments, project managers, and other relevant managers attended the training.
During the lecture, Attorney Wang Tao took the legal issues faced by actual constructors as a starting point, focusing on the pain points, key concerns, difficult issues, and current hot topics that construction enterprises are particularly concerned about in engineering disputes. He provided detailed explanations on matters such as the definition of the status of an actual constructor, the requirements for entities that can break through the principle of contractual relativity, the prerequisite conditions for requesting price reduction compensation, how people’s courts handle the joint trial of claims filed by contractors and actual constructors, restrictions on separately asserting rights, the treatment of contractors’ requests for management fees from actual constructors, whether the project owner can invoke the contractor’s failure to issue invoices as a defense of prior performance to refuse payment of the project balance, whether the original agreed-downward rate should still be applied when adjusting the fee standards for construction cost appraisal, and whether contractors can simultaneously claim both liquidated damages and interest on unpaid project payments.
The lecture featured not only a precise breakdown of laws and judicial interpretations but also insightful wisdom for overcoming real-world challenges. Through Attorney Wang Tao’s meticulously detailed sharing, attendees were equipped with invaluable practical tips and gained a fresh legal perspective as well as profound insights.
Through this session, participants not only deepened their understanding of the laws and regulations related to construction projects but also gained a clearer grasp of the judicial authorities’ views on adjudicating engineering contract disputes in judicial practice.
