Promote the further improvement of the socialist rule-of-law system with Chinese characteristics.

The Decision adopted at the Third Plenary Session of the 20th Central Committee of the Party, starting from the perspective of further deepening reform in a comprehensive manner and advancing Chinese-style modernization, proposes in its “General Discussion” to promote the further perfection of the socialist rule-of-law system with Chinese characteristics, and devotes an entire chapter to “Improving the Socialist Rule-of-Law System with Chinese Characteristics.” This indicates that, within the top-level design of the Party Central Committee, further perfecting the socialist rule-of-law system with Chinese characteristics is not only a goal and task for deepening the comprehensive governance of the country according to law, but also a goal and task for further advancing comprehensive deepening of reform. On this new journey, further perfecting the socialist rule-of-law system with Chinese characteristics is an inevitable requirement for deepening the comprehensive governance of the country according to law and building a socialist rule-of-law state at a higher level; it is an inevitable requirement for further deepening comprehensive reform under the rule of law and advancing Chinese-style modernization; and it is an inevitable requirement for continuously improving and developing the socialist system with Chinese characteristics and promoting the modernization of the national governance system and governance capacity.

From now until 2029, the key tasks for further perfecting the socialist rule-of-law system with Chinese characteristics are as follows: First, further strengthen the construction of the rule-of-law regulatory framework by continuing to improve the socialist legal system with Chinese characteristics centered on the Constitution, and by refining the legal systems urgently needed for national governance, those essential to meeting the people’s growing aspirations for a better life, and those critical for safeguarding national security. Second, further enhance the construction of the rule-of-law implementation system by establishing and improving a system that ensures the full implementation of the Constitution; deeply advancing law-based administration and deepening reform of the administrative law enforcement system; perfecting mechanisms for fair law enforcement and judicial administration, and ensuring that supervisory authorities, public security organs, procuratorial organs, trial courts, and judicial administrative agencies each perform their respective duties while maintaining mutual coordination and checks and balances among supervisory power, investigative power, prosecutorial power, adjudicatory power, and enforcement power; and fostering a socialist rule-of-law culture, promoting the spirit of socialist rule of law, inheriting China’s outstanding traditional legal culture, and making respect for, study of, observance of, and application of the law a common pursuit and conscious action shared by all the people. Third, further strengthen the construction of the rule-of-law oversight system by building a rule-of-law oversight system under the unified leadership of the Party, characterized by comprehensive coverage, authority, and efficiency, and by perfecting the system of checks and balances on the exercise of power. Fourth, further enhance the construction of the rule-of-law guarantee system by improving the institutional framework and mechanisms for comprehensively governing the country according to law. Fifth, further strengthen the construction of the Party’s internal regulations and systems, and establish sound mechanisms for aligning and coordinating Party regulations with state laws and regulations. Sixth, further bolster the construction of rule-of-law systems in specific areas of national governance, such as the foreign-related rule-of-law system and the national security rule-of-law system.

To improve the socialist rule-of-law system with Chinese characteristics, we must uphold the correct direction, adhere to the leadership of the Party, uphold the socialist system, implement Xi Jinping’s thought on the rule of law, take root in Chinese culture, ground ourselves in China’s national conditions, and address China’s own problems. We must highlight the distinctive features of China—its unique characteristics, practical features, cultural features, and features of the times.
