Graduated from the Law School of Renmin University of China in 1995 with a major in Economic Law. Since beginning practice in 1999, I have been engaged for a long time in corporate bankruptcy liquidation, reorganization, and other corporate legal services. I have been fully involved in 62 bankruptcy liquidation, reorganization, and compulsory liquidation cases handled by Tongfang, including those involving Shenyang Dajun Porcelain Co., Ltd., Shenyang Jinmeida Ceramics Co., Ltd., Shenyang Xinguang Huachen Automotive Engine Co., Ltd., Shenyang Xingchen Real Estate Development Co., Ltd., China Nonferrous (Shenyang) Metallurgical Machinery Co., Ltd., Fushun Cement Co., Ltd., and Qingyuan Manchu Autonomous County Jinyulong Mining Co., Ltd.
1. The bankruptcy and reorganization case of China Nonferrous (Shenyang) Metallurgical Machinery Co., Ltd. (the reorganization plan has been fully implemented). Shenyang Metallurgical Machinery has a development history spanning 82 years. As a controlled subsidiary of a central state-owned enterprise, it is one of the world’s three major suppliers of aluminum production equipment and the largest supplier in Asia of nickel-iron rotary kilns, large-scale mixers, and large-scale ball mills. The company covers a total area of approximately 586,000 square meters and holds a total of 41 valid invention patents. It has received 18 national and provincial/ministerial-level science and technology progress awards, including the China Invention Patent Award, and has participated in the formulation and revision of 12 national industry standards. Shenyang Metallurgical Machinery employs over 1,500 active workers, more than 3,500 retired employees, and over 1,500 employees from its collectively-run factory offices. After being appointed on August 17, 2020, Tongfang conducted a series of tasks—including takeover, creditor review, preliminary investigation of employee claims, and audit and valuation—resulting in the acceptance of 578 creditors with a total of 580 claim filings amounting to over 3 billion yuan, of which over 2.7 billion yuan were confirmed. On October 23, 2020, a creditors’ meeting was held, during which all proposed resolutions were approved by an overwhelming majority. The company has successfully attracted investors, restructured its capital base, optimized its product portfolio, and reformed its personnel structure, thereby achieving its goal of transforming and upgrading the reorganized enterprise. All related work has been progressing smoothly and in an orderly manner. On November 30, 2022, the reorganization plan was fully implemented, and the court ruled to terminate the reorganization proceedings.
2. The bankruptcy reorganization case of Jinyulong Mining Co., Ltd. in Qingyuan Manchu Autonomous County (reorganization plan fully implemented). On January 13, 2022, the People’s Court of Qingyuan Manchu Autonomous County issued a ruling accepting the bankruptcy reorganization application. On the same day, the Liquidation Group of Jinyulong Mining was appointed as the bankruptcy administrator of Jinyulong Mining, with Liaoning Tongfang Law Firm serving as the head of the Liquidation Group. On November 11, 2022, the People’s Court of Qingyuan Manchu Autonomous County ruled to approve Jinyulong Mining’s reorganization plan. After the administrator thoroughly sorted through and confirmed various claims, the long-standing debts owed to employees—accumulated over eight years—were finally settled, and claims held by suppliers and villagers’ private loans were also successfully resolved. Following a series of operations including maintenance and repairs of underground mines and processing plants, the company resumed production and operations in 2023. As of May 11, 2023, the reorganization plan has been fully implemented. This reorganization will soon generate profits that will significantly boost Qingyuan County’s tax revenue and fiscal resources, while also creating numerous employment opportunities for the local community and revitalizing commercial activities around the mine area.
3. The bankruptcy and reorganization case of Shenyang Xingchen Real Estate Development Co., Ltd. (the reorganization plan is currently being implemented). The case involves 500 homebuyers who, between 2015 and 2019, repeatedly staged protests at the site of the stalled construction project—including hanging national flags, unfurling banners, and setting up tents—to safeguard their rights, thereby drawing attention from both the government and society. Since being entrusted with this task, Tongfang has deeply felt the weight of its responsibility and the honor of its mission, and has been determined not to slacken in any way. The administrator has repeatedly briefed local governments on the bankruptcy proceedings, proactively convened meetings with homebuyers on numerous occasions, established a dedicated WeChat public account for the administrator to disseminate information, and created an official platform for the administrator’s communication and public opinion management. Moreover, the administrator has taken the initiative to contact key creditors and actively sought support from all stakeholders, thereby systematically defusing many potential conflicts. At the creditors’ meeting, the draft reorganization plan prepared by the administrator was approved by an overwhelming majority. On May 8, 2023, the Shenyang Intermediate People’s Court ruled to approve Xingchen Company’s reorganization plan and terminate the reorganization proceedings.
